MDT Home Health Care Agency, Inc. All documentation pertaining to an Employee injury or illness must be kept in the employee’s Health file. It cannot be kept in the personnel file. Neither MDT Home Health Care Agency, Inc. nor the insurance carrier will be liable for the payment of Workers’ Compensation benefits for injuries that occur during an Employees voluntary participation in any off-duty, recreational, social, or athletic activity sponsored by MDT Home Health Care Agency, Inc. Employees may not use Paid Time Off (PTO) for a work-related injury if the injury is deemed compensable under applicable State law. POST ACCIDENT SCREENING Employees involved in any on-the-job accident requiring medical treatment beyond first aid will be required to submit to testing for the presence of illegal drugs or alcohol in his/her system. Employees involved in the injury of a patient or co-worker requiring medical treatment will be required to submit to testing for the presence of illegal drugs or alcohol in his/her system. Post-accident testing shall be conducted as soon after the accident as possible, but no later than twelve (12) hours after the accident. If an Employee refuses to submit to post-accident testing, it may be cause for written corrective action, including termination of employment. An Employee who refuses to submit to or cooperate with a blood or urine test after the accident, as set forth in this policy and in MDT Home Health Care Agency, Inc.’s drug and alcohol policy, may forfeit any right to Workers’ Compensation benefits as permitted by State law. A positive drug test conducted and evaluated pursuant to standards adopted for drug testing by the U.S. Department of Transportation should be conclusive presumptions of impairment resulting from the use of illegal drugs. A positive test result for alcohol or drugs for an accident will be cause for written corrective action, up to and including, termination of employment.
