MDT Home Health Care Agency, Inc. EMPLOYMENT CATEGORIES POLICY: It is the intent of MDT Home Health Care Agency, Inc. Agency to clarify the definitions of employment classifications so that Employees understand their employment status and benefit eligibility. All Employees of MDT Home Health Care Agency, Inc. Agency are classified into one of the following categories of employment: Regular full-time: Those Employees who are not in a temporary status and who are regularly scheduled to work thirty-two (32) or more hours per week. Generally, they are eligible for full-time benefits package, subject to the terms, conditions, and limitations of each benefit program. Regular part-time: Those Employees who are not assigned to a temporary status and who are regularly scheduled to work less than thirty-one (31) hours per week, but at least twenty (24) hours per week. They are eligible for part-time benefits program subject to the terms, conditions, and limitations of each benefit program. Casual/PRN: An Employee who is scheduled intermittently, as available, or as needed. Temporary: An Employee, who is hired on a temporary basis (i.e., less than ninety (90) days), is a temporary Employee. PROCEDURE: The Human Resource Department should be notified by the Supervisor or designee when an Employee changes status. · The Human Resource Department is to notify the Employee if a change in their employment category affects benefit eligibility and shall retain records in the personnel file that document the notification. · Part-time Employees not on a temporary assignment who are regularly scheduled to work thirty-two (32) or more hours per week for a period of ninety (90) days may become Regular Full-time Employees. Part-time Employees may become full-time, before this time, if the Supervisor determines a full-time position is available. (Temporary assignment i.e., working in place of another Employee on an LOA). · An Employee changing status from PRN to full or part-time will have a benefit eligibility date, effective the first day of the pay period after the change in status. · The benefit eligibility date shall be used for seniority purposes. · An employee will be classified as exempt or non-exempt. · An exempt employee is one whose job duties, responsibilities and rate of pay permit the employee to be exempt from the overtime pay requirements of the Federal Wage and Hour regulations. Those administrative and professional jobs which meet the defined requirements include such jobs as directors, managers, registered nurses, physical therapists, occupational therapists, speech therapists and medical social workers. · A non-exempt employee is one whose job duties, responsibilities and rate of pay do not permit exemption from the overtime pay provisions of the Federal Wage and Hour regulations. This includes home health aides, licensed physical therapy assistants, licensed practical nurses, clerical, secretarial and administrative staff.
